By downloading, installing, accessing, or using the MINE application ("App", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately cease use of the Service and uninstall the App from your device.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and Offline Protocol, Inc. ("Company", "we", "us", "our"), a corporation incorporated under the laws of the State of Delaware, United States.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via the email address associated with your account. Changes become effective upon posting unless we specify a later effective date. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
You must be at least 13 years of age to use this Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Service, you represent and warrant that:
To use the Service, you must create an account using a valid email address via the OfflineID authentication system. You will select a unique username during registration. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
The Service uses one-time passcode (OTP) verification delivered via email (SendGrid) for authentication. You are responsible for maintaining the security of the email address used for authentication. You must immediately notify us at [email protected] of any unauthorized use of your account or any other breach of security.
Each user may maintain only one (1) active account. Creating multiple accounts for any purpose, including but not limited to accumulating additional points, rewards, referral bonuses, or circumventing enforcement actions, is strictly prohibited and constitutes grounds for immediate termination of all associated accounts and forfeiture of all accumulated points and rewards.
You are solely responsible for all activity that occurs under your account, whether or not authorized by you. This includes all mining activity, mission completions, referral activity, wallet connections, vault claims, and any blockchain transactions initiated through the Service. We are not liable for any loss or damage arising from unauthorized use of your account.
Your username, avatar, bio, and linked social accounts are publicly visible to other users via the leaderboard and profile features. You may not select a username or profile content that: (a) impersonates another person or entity, (b) is offensive, vulgar, or inappropriate, (c) infringes on any trademark or intellectual property right, (d) is designed to confuse or mislead other users, or (e) is otherwise inappropriate or violates any applicable law.
MINE is a mobile application that enables users to participate in the Offline Protocol mesh network by operating their device as a mesh relay node. Users earn points ("Points") for their network contributions, complete missions, participate in referral programs, and compete on leaderboards.
The core function of the Service is mesh relay mining. When mining is active, your device operates as a relay node within the Offline Protocol mesh network, using Bluetooth Low Energy (BLE) to relay encrypted data packets between other mesh participants. Your device advertises its presence and availability to nearby devices, processes encrypted data transit, and earns Points based on your participation. Mining consumes device battery and may use mobile data when internet relay (DORS) is active.
The Service offers a mission system that rewards users with Points for completing specified tasks. Mission types include:
Mission availability, parameters, reward amounts, and types are determined by us at our sole discretion and may be modified, added, or removed at any time without prior notice.
The Service includes a referral program. Each user receives a unique referral code that may be shared with others. When a new user registers using your referral code, both the referrer and the referred user may receive bonus Points, subject to the terms of the referral program then in effect. Referral program terms, bonus amounts, and eligibility criteria are determined by us at our sole discretion and may be modified or discontinued at any time.
The Service features a competitive leaderboard ranking users by their accumulated Points. Leaderboard visibility means your username, avatar, and Point totals are publicly visible to all users of the Service.
The Service provides a real-time mesh topology map displaying network activity. This visualization is for informational purposes only and may not reflect the precise or complete state of the mesh network at any given time.
The Service allows you to optionally connect external cryptocurrency wallets (Ethereum via Reown/WalletConnect and Solana via Mobile Wallet Adapter) to your account. Connected wallets may be used to claim token rewards from on-chain vault smart contracts, subject to availability. Wallet integration and vault claim features are described in further detail in Section 9.
Points earned through the Service are digital records tracked within the MINE system. Points represent a measure of your participation in the Offline Protocol mesh network and completion of missions. Points are not currency, securities, commodities, or any form of financial instrument. Points have no inherent monetary value, and no cash, credit, or refund will be issued for Points under any circumstances, except as explicitly provided through the vault claim mechanism described in Section 9.

Point earnings may be subject to multipliers based on various factors, including but not limited to mission difficulty, recurrence type, geographic zone type, distance traveled, and other parameters. Multiplier values and calculation methodologies are determined by us at our sole discretion.

Points are synced between your device and our servers via the Points synchronization service. In the event of a discrepancy between local and server-side Point balances, the server-side balance shall be authoritative and controlling.
The existence of Points within the Service does not create any obligation on our part to provide any mechanism for converting, exchanging, redeeming, or otherwise monetizing Points. Any conversion mechanism that may be offered (such as vault claims) is provided at our sole discretion and may be modified, suspended, or terminated at any time.
The mesh relay feature requires Bluetooth Low Energy (BLE) permissions on your device. When mining is active, your device will:
You may disable Bluetooth access at any time through your device settings, which will disable mesh networking and mining functionality.
By using the mesh relay mining feature, you acknowledge and consent that your device will process and relay encrypted data packets originating from other users and participants in the Offline Protocol mesh network. You do not have access to the content of these encrypted packets. The data transiting through your device is encrypted and you have no ability or right to decrypt, inspect, modify, or store this transit data. You are acting solely as a passive relay node.
The Service utilizes Dynamic Opportunistic Relay Switching (DORS), which automatically selects the optimal data transport method from among BLE, WiFi Direct (on supported Android devices), and internet relay. When internet relay is used, data will be transmitted over your device's internet connection, which may consume mobile data and incur charges from your wireless carrier.
Mesh relay data may utilize industry-standard encryption protocols for session-based security between peers. While we implement robust encryption, no method of electronic transmission is 100% secure, and we cannot guarantee absolute security of data in transit.
Mesh relay mining consumes device resources including battery power, processing capacity, and potentially mobile data (when DORS selects internet relay). The rate of resource consumption varies based on network activity, number of connected peers, data volume being relayed, and device capabilities. You are solely responsible for monitoring and managing your device's resource consumption, and we are not liable for any costs, charges, or device degradation arising from your use of the mining feature.
Mesh networking functionality depends on the proximity, number, and connectivity of other devices participating in the Offline Protocol mesh network. We do not guarantee the availability, reliability, throughput, or performance of the mesh network at any time or in any location.
Required for mesh relay mining and network participation. Without Bluetooth permissions, the core mining functionality of the Service will be unavailable.
Required for geo-missions. The Service requests both foreground and background location permissions to verify your physical presence within designated geographic zones for geo-mission completion. Location data processing for mission verification occurs on your device and is not transmitted to our servers for this purpose. You may deny location permissions, but geo-missions will be unavailable. See Section 8 for detailed information about location-based features.
Used for capturing or selecting a profile avatar image. Camera and photo library access is requested only when you initiate avatar selection. You may deny these permissions without affecting other Service functionality.
The Service uses Firebase Cloud Messaging (FCM) and Apple Push Notification service (APNs) to deliver notifications about mining status, mission availability, reward alerts, and other Service communications. By enabling notifications, you consent to the transmission of device tokens to these third-party services for notification delivery.
The Service may offer optional biometric authentication (Face ID, Touch ID, or equivalent) for added account security. Biometric data is processed entirely by your device's operating system and is never transmitted to or stored by us.
Geo-missions are location-based tasks that require you to be physically present within a designated geographic zone. Zones are generated using a grid-based system (approximately 0.006-degree cells, or roughly 660 meters) with a geofence verification radius of 350 meters. Zones are organized into distance rings from your base location:
Point rewards for geo-missions are subject to multipliers based on zone type and distance, with more distant and difficult zones offering higher potential rewards.
Location data used for geo-mission verification is processed on your device. Your precise GPS coordinates are not transmitted to our servers for the purpose of geo-mission zone verification. However, general location data may be collected for other Service purposes as described in our Privacy Policy.
To prevent abuse of the geo-mission system, the following limits apply (subject to change at our discretion):
Geo-mission verification relies on your device's GPS hardware and software. We do not guarantee the accuracy of GPS positioning, and location accuracy may be affected by environmental factors including but not limited to building obstructions, atmospheric conditions, device hardware limitations, and GPS satellite availability. We are not responsible for your inability to complete a geo-mission due to location inaccuracy.
The use of GPS spoofing tools, mock location providers, VPN-based location manipulation, emulators, or any other means to falsify or manipulate your geographic location for the purpose of completing geo-missions is strictly prohibited. Violations will result in immediate account termination and permanent forfeiture of all accumulated Points and rewards without prior notice or appeal.
Geo-missions may direct you to travel to various geographic locations. You are solely responsible for your personal safety when traveling to complete geo-missions. You should exercise sound judgment and caution, obey all traffic and pedestrian laws, avoid unsafe areas, and never attempt to complete a geo-mission if doing so would put you or others at risk. We are not liable for any injury, property damage, or loss arising from your travel to or presence at any geo-mission location.
The Service allows you to optionally connect external cryptocurrency wallets to your account:
Wallet connection is optional and is not required to use the core mining and mission features of the Service. When you connect a wallet, you provide your public wallet address to the Service. We never have access to, custody of, or control over your private keys, seed phrases, or wallet funds. Your wallet remains entirely under your control at all times.
The Service may offer the ability to claim token rewards from on-chain smart contracts ("Vault Contracts" or "TokenVault"). Vault claims allow you to convert accumulated Points into blockchain tokens, subject to availability, eligibility, and the terms then in effect.
As of the effective date of these Terms, vault claim functionality operates on the Ethereum Sepolia testnet. Testnet tokens have no monetary value. When and if vault claims transition to a mainnet blockchain, we will update these Terms accordingly. You acknowledge that there is no guarantee that vault claims will ever be available on any mainnet blockchain.
All blockchain transactions are final and irreversible. Once a vault claim transaction is signed by you in your external wallet application and submitted to the blockchain, it cannot be reversed, canceled, or modified by us or any third party. You are solely responsible for:
Vault Contracts are deployed smart contracts on public blockchain networks. You acknowledge and accept the inherent risks associated with smart contracts, including but not limited to:
We do not guarantee the correct, uninterrupted, or error-free operation of any smart contract, and we are not liable for any loss of tokens, funds, or value arising from smart contract interactions.
We do not hold, custody, transmit, or control any cryptocurrency, tokens, or digital assets on your behalf. The Service facilitates the connection between your account and your self-custodied wallet, and presents claim transactions for your review and signature. All custody and control of digital assets remains with you at all times.
Points and any tokens received via vault claims are not securities, investment contracts, equity interests, debt instruments, or any form of investment product. Points and tokens are functional utility rewards for network participation. We make no representation regarding the current or future monetary value of Points or tokens. You should not acquire or hold Points or tokens with any expectation of profit, appreciation, or financial return. Nothing in these Terms or the Service constitutes investment advice, financial advice, or a solicitation to purchase securities.
You are solely responsible for determining and fulfilling any tax obligations arising from your receipt, holding, or disposition of Points, tokens, or any other rewards received through the Service. We do not provide tax advice and make no representations regarding the tax treatment of any rewards. You should consult a qualified tax professional regarding your specific circumstances.
We do not guarantee that tokens will be available for vault claims at any time. Token availability depends on the funding of Vault Contracts, blockchain network status, smart contract functionality, and other factors. We may modify, suspend, or discontinue vault claim functionality at any time at our sole discretion.
User Content within the Service is limited to profile information you provide, including your username, biography text, avatar image, and linked social account information.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of providing and operating the Service. For avatar images, this includes storage on our infrastructure (hosted via Hetzner Cloud) and display to other users.
You agree not to submit User Content that:
We reserve the right to review, remove, or restrict access to any User Content that violates these Terms, our community standards, or applicable law, at our sole discretion and without prior notice.
The Service uses Firebase Cloud Messaging (FCM) and Apple Push Notification service (APNs) to deliver push notifications regarding mining status, mission updates, reward notifications, referral activity, and other Service-related communications.
To deliver notifications, we collect and store your device push token, device model, operating system version, and app version. This information is associated with your account and used solely for notification delivery and Service compatibility purposes.
You may disable push notifications at any time through your device settings. Disabling notifications will not affect core Service functionality but may cause you to miss time-sensitive mission opportunities or reward notifications.
The Service integrates with the following third-party services:
Your use of the Service may be subject to the terms and conditions of these third-party service providers. We are not responsible for the availability, accuracy, security, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you interact with through the Service.
The Service interacts with public blockchain networks (Ethereum and Solana) that are decentralized and not owned, operated, or controlled by us. We have no control over the operation, security, or availability of any blockchain network and are not responsible for any issues arising from blockchain network operation.
When you connect an external wallet, you interact with third-party wallet applications (e.g., MetaMask, Phantom, or other WalletConnect/MWA-compatible wallets). We are not responsible for the security, functionality, or reliability of any third-party wallet application.
The Service, including its design, source code, object code, algorithms, features, functionality, user interface, graphics, documentation, and all related intellectual property, is owned by Offline Protocol, Inc. and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. The Offline Protocol Mesh SDK, OfflineID SDK, DORS protocol, and all related technologies are proprietary to Offline Protocol, Inc.
"MINE", "Offline Protocol", "OfflineID", "DORS", and associated logos, designs, and trade dress are trademarks or registered trademarks of Offline Protocol, Inc. You may not use these marks without our prior written consent.
Any feedback, suggestions, bug reports, or ideas you provide about the Service ("Feedback") may be used by us without any obligation, compensation, or attribution to you. By providing Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service or any other product or service.
The Service may incorporate open-source software components, each of which is subject to its own applicable license terms. Nothing in these Terms limits your rights under, or grants you rights that supersede, any applicable open-source license.
You agree not to:
We reserve the right to investigate suspected violations of these Terms using technical, analytical, and other means at our disposal, including monitoring of mining activity patterns, location data anomalies, referral chains, and blockchain transactions.
Violation of these Terms may result in, at our sole discretion and without prior notice:
Enforcement decisions are made at our sole discretion. While we may, but are not obligated to, provide a process for disputing enforcement actions, our decisions regarding account termination and Point forfeiture are final.
You may request deletion of your account at any time through the App settings or by contacting us at [email protected]. Account deletion may require identity verification via a one-time passcode. Upon verified request, your account will be scheduled for permanent deletion after a thirty (30) day grace period, during which you may cancel the deletion request by logging back in.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, suspected fraudulent or illegal activity, multi-accounting, manipulation of the rewards system, extended periods of inactivity, or requests from law enforcement.
Upon termination:
Sections 5.1 (Nature of Points), 9 (Blockchain, Wallet Integration, and Vault Claims), 13 (Intellectual Property), 15 (Enforcement and Consequences), 17 (Disclaimers), 18 (Limitation of Liability), 19 (Indemnification), 20 (Dispute Resolution), and 21 (General Provisions) shall survive any termination or expiration of these Terms.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. MESH NETWORKING AVAILABILITY DEPENDS ON THE PROXIMITY, NUMBER, AND CONNECTIVITY OF OTHER DEVICES PARTICIPATING IN THE OFFLINE PROTOCOL MESH NETWORK. MINING REWARDS ARE NOT GUARANTEED AND MAY VARY BASED ON NETWORK CONDITIONS, PARTICIPATION LEVELS, AND OTHER FACTORS BEYOND OUR CONTROL.
WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING: (A) THE AVAILABILITY, AMOUNT, OR CONTINUITY OF POINTS, REWARDS, OR TOKENS; (B) THE CURRENT OR FUTURE MONETARY VALUE OF POINTS OR TOKENS; (C) THE FUNCTIONALITY OR AVAILABILITY OF VAULT CONTRACTS OR BLOCKCHAIN NETWORKS; (D) THE CONVERTIBILITY OF POINTS TO TOKENS OR ANY OTHER FORM OF VALUE; OR (E) THE LIQUIDITY, TRADABILITY, OR MARKET ACCEPTANCE OF ANY TOKENS. POINTS AND TOKENS MAY BECOME WORTHLESS. YOU SHOULD NOT RELY ON THE SERVICE AS A SOURCE OF INCOME.

WE ARE NOT RESPONSIBLE FOR THE AVAILABILITY, ACCURACY, SECURITY, OR PRACTICES OF THESE THIRD-PARTY SERVICES AND DISCLAIM ALL LIABILITY ARISING FROM YOUR USE OF OR RELIANCE ON THIRD-PARTY SERVICES.
WE ARE NOT RESPONSIBLE FOR DEVICE BATTERY DRAIN, MOBILE DATA CHARGES, DEVICE WEAR, OR ANY OTHER COSTS OR DAMAGES TO YOUR DEVICE ARISING FROM YOUR USE OF THE MINING, MESH RELAY, OR OTHER FEATURES OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFFLINE PROTOCOL, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE TOTAL AMOUNT YOU HAVE PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Offline Protocol, Inc. and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in any way connected with:
(a) Your access to or use of the Service, including mining activity, mission completions, and mesh relay participation; (b) Your User Content, including your profile information and avatar; (c) Your connection of an external wallet and any vault claims or blockchain transactions initiated through the Service; (d) Your violation of these Terms; (e) Your violation of any applicable law, regulation, or third-party right, including any intellectual property, privacy, or publicity right; (f) Any dispute between you and any other user of the Service; (g) Your travel to or presence at any location in connection with geo-missions; (h) Any tax liability arising from your receipt of Points, tokens, or other rewards.
This indemnification obligation shall survive the termination of your account and these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Offline Protocol, Inc. agree to submit to the exclusive personal jurisdiction of the state and federal courts located in the State of Delaware for the purpose of litigating any such dispute.
Before initiating any formal dispute resolution proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within this period, either party may proceed with the formal dispute resolution process described below.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, your Points, your tokens, or any related matter (collectively, "Disputes") shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English by a single arbitrator selected in accordance with the AAA rules. The arbitration may be conducted in person, by video conference, by telephone, or based on written submissions, as determined by the arbitrator. The arbitral decision shall be in writing, shall include findings of fact and conclusions of law, and may be enforced in any court of competent jurisdiction.
Payment of arbitration fees shall be governed by the AAA's Consumer Arbitration Rules. If the arbitrator finds that your claim was brought in good faith and is not frivolous, we will pay all filing, administration, and arbitrator fees associated with the arbitration. If the arbitrator finds the claim to be frivolous, fee allocation shall be governed by the AAA rules and applicable law.
YOU AND OFFLINE PROTOCOL, INC. EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION, COURT, OR OTHERWISE, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING. YOU AND OFFLINE PROTOCOL, INC. EACH WAIVE ANY RIGHT TO A JURY TRIAL. If for any reason a claim proceeds in court rather than arbitration, you and we each waive any right to a jury trial. If a court of competent jurisdiction finds the class action waiver in this section to be unenforceable as to any particular claim or request for relief, then the parties agree that such claim or request for relief shall be severed and proceed in individual arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, or to address unauthorized access to or use of the Service.

The notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, you and we agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ACCRUED, OR IT SHALL BE PERMANENTLY BARRED. This limitation applies regardless of any statute of limitations that might otherwise apply.
These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Offline Protocol, Inc. regarding the Service and supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, relating to the Service.
If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
You may not assign, delegate, or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their respective successors and permitted assigns.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemics, epidemics, natural disasters, government orders or actions, failures of third-party services, blockchain network outages or disruptions, internet service provider failures, power outages, or labor disputes.
These Terms are intended solely for the benefit of you and Offline Protocol, Inc. and do not confer any rights on any third party, except as expressly provided herein.
The section headings in these Terms are for convenience of reference only and shall not affect the interpretation of these Terms.
By using the Service, you consent to receiving electronic communications from us. You agree that all notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and the sanctions programs maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control.
If you are a U.S. government end user, the Service is a "Commercial Item" as defined in 48 C.F.R. Section 2.101, and is licensed to you in accordance with the terms of these Terms.
